Careless driving charges can also be levied in parking lots: OPP

The Huntsville Detachment of the Ontario Provincial Police want to share that in December 2024 the Province of Ontario amended the Highway Traffic Act of Ontario, specifically the offense of Careless Driving, section 130(1). 

Previously, the offense was limited to vehicles on a highway/roadway but now includes parking Lots. 

The hope is that all drivers will do their best to avoid placing other motorists and pedestrians in harm’s way. Please pay attention to your driving and be safe.

Careless driving is defined as;

130 (1) Every person is guilty of the offence of driving carelessly who drives a vehicle or street car on a highway or in a specified place without due care and attention or without reasonable consideration for other persons using the highway or specified place. 2024, c. 27, Sched. 8, s. 11 (1).

Definitions

“specified place” means,

(a) any parking lot, structure or garage, whether public or private, paved or unpaved, flat or multilevel, above or below grade, including any driveway or road that connects the parking lot to a highway,

(b) any parking lot into which drivers are expressly or impliedly invited or permitted to enter, with or without payment, and no matter whether payment was made or whether the driver entered with or without permission; and

(c) any private, commercial or industrial parking lot from which the public would ordinarily be excluded.

Careless driving penalties in Ontario include fines, demerit points, and license suspension.  Examples of the type of penalty drivers can face are;

  •  Fines from $490-$2,000, depending on circumstances
  • 6 demerit points
  • 30-day license suspension for novice drivers
  • Up to 2 years in jail for serious offenses
  • Increased insurance costs
  • The charge stays on your record for three years from the conviction date 
  • The fine is double in construction and community safety zones 

Drivers and members of the public are reminded to respect our communities, comply with all laws and not jeopardize the safety of our citizens or our neighbourhoods.
