A man who threw coffee at a drive-through worker pleaded guilty in court this week to assault and breaching court-ordered conditions.
Appearing virtually in Bracebridge court on Tuesday, Devin Turcotte, 23, admitted to his crimes and was sentenced to time served.
The court heard that on December 2, 2021 the OPP were called to an assault which had occurred at a Tim Hortons in Huntsville. The police spoke with staff at the Tim Hortons who informed them that an unknown male was in the drive-through when he threw coffee at an employee inside.
The vehicle was identified and on December 5 the police found the vehicle parked at a local inn, and Turcotte was arrested.
As a result of the arrest, Turcotte was not permitted to be in the vicinity of the Tim Hortons. However, on March 29, 2021, the victim of the previous assault was again working the drive-through when she saw Turcotte pull up–this time as the passenger in another vehicle.
The victim recognized Turcotte and was aware of his court orders. Her supervisor contacted the police and Turcotte was arrested again.
Crown attorney Melissa MacDonald called the assault degrading, and of particular concern since Turcotte had attacked a complete stranger.
Turcotte had no rationale for the assault and admitted that he had shown poor judgment.
Crown attorney MacDonald asked for 20 days jail, which Turcotte had already served in pre-trial custody.
“Time to grow up,” said Justice Douglas in passing sentence.

He should get double time for his “double double”!
Justice needs to happen; I might gently suggest that there may be underlying issues for this individual that need to be addressed. Under our penal system, jail time probably won’t fix that. Sad.
Time to grow up in deed Mr. Turcotte. Any bets that will happen soon? Not likely.
