{"id":62768,"date":"2019-03-01T09:13:45","date_gmt":"2019-03-01T14:13:45","guid":{"rendered":"https:\/\/huntsville.dopperonline.ca\/?p=62768"},"modified":"2019-03-01T09:13:45","modified_gmt":"2019-03-01T14:13:45","slug":"in-the-case-of-snc-the-pm-has-chosen-political-meddling-over-rule-of-law-dave-wilkin","status":"publish","type":"post","link":"https:\/\/doppleronline.ca\/huntsville\/in-the-case-of-snc-the-pm-has-chosen-political-meddling-over-rule-of-law-dave-wilkin\/","title":{"rendered":"In the case of SNC, the PM has chosen political meddling over rule of law ~ Dave Wilkin"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>The bombshell <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/politics\/trudeau-snc-lavalin-fraud-corruption-1.5009578\">Globe &amp; Mail report<\/a><\/span> that the PMO had pressured former Justice Minister and Attorney General (AG) Jody Wilson-Raybould (Canada\u2019s 1<sup>st<\/sup> Aboriginal AG) to intervene in <span style=\"text-decoration: underline;\"><a href=\"https:\/\/business.financialpost.com\/news\/rcmp-charges-snc-lavalin-with-fraud-and-corruption-linked-to-libyan-projects\">criminal proceedings against engineering giant SNC-Lavalin<\/a><\/span> (SNC) is most troubling. Here\u2019s the story so far.<\/p>\n<div style=\"float: left; margin-right: 14px;\"><strong><broadstreet-zone zone-id=\"45658\" keywords=\"\" soft-keywords=\"true\" zone-alias=\"\"><\/broadstreet-zone><\/strong><\/div>\n<p>Things first got rolling with the passage of an amendment to the Canadian Criminal Code &#8211; a brand new Deferred Prosecution Agreement (DPA) law &#8211; buried deep within the 2018 <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/politics\/snc-lavalin-trudeau-bribery-fraud-wilson-raybould-1.5020498\">500-page omnibus budget bill<\/a><\/span>. It\u2019s a useful prosecutor\u2019s tool that stays criminal proceedings in exchange for other less severe remediation penalties. An important, but seldom discussed <span style=\"text-decoration: underline;\"><a href=\"https:\/\/business.financialpost.com\/news\/fp-street\/heres-how-a-new-escape-route-could-open-up-for-snc-lavalin?video_autoplay=true\">PSPC&#8217;s Integrity Regime<\/a><\/span> update (still in process) followed, providing government flexibility in applying federal procurement bans.<\/p>\n<p>All appeared to be on track \u2026 then the wheels started coming off; the ensuing political scandal is akin to watching a slow-moving train wreck:<\/p>\n<ul>\n<li>Last October the Director of Prosecution Services of Canada (PPSC), Kathleen Roussel <a href=\"https:\/\/wwwhive.com\/2019\/02\/10\/top-prosecutor-defends-independence-and-decision-to-prosecute-snc-lavalin\/\"><span style=\"text-decoration: underline;\">rejected SNC\u2019s request to negotiate a deferred prosecution<\/span><\/a> (under the DPA) with the subsequent <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/politics\/snc-lavalin-trudeau-bribery-fraud-wilson-raybould-1.5020498\">AG\u2019s support<\/a><\/span> and decision to not intervene.<\/li>\n<li>In January, the PM shuffles Ms. Wilson-Raybould over to Veterans Affairs (VA), claiming <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.huffingtonpost.ca\/2019\/01\/14\/jody-wilson-raybould-veterans-affairs_a_23642218\/\">it\u2019s not a demotion<\/a>.<\/span><\/li>\n<li>The Globe story breaks, the PM responds, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/globalnews.ca\/news\/4934682\/justin-trudea-pmo-snc-lavalin-jody-wilson-raybould\/\">calling the story \u201cfalse\u201d<\/a><\/span>, stating he didn\u2019t \u201c<strong><em>direct<\/em><\/strong>\u201d her.<\/li>\n<li>The new AG (Lametti) states he hasn\u2019t \u201c<span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-attorney-general-lametti-says-snc-lavalin-settlement-still-possible\/\">ruled out deferred prosecution for SNC<\/a><\/span>\u201d<\/li>\n<li><a href=\"https:\/\/www.nationalobserver.com\/2019\/02\/11\/news\/politicians-denounce-trudeau-government-sexist-treatment-jody-wilson-raybould\"><span style=\"text-decoration: underline;\">Personal character attacks against Ms. Wilson-Rayboyld<\/span><\/a> surface, reportedly leaked by a handful of anonymous Liberal Party sources (aka. \u2018political hacks\u2019), prompting a PM <span style=\"text-decoration: underline;\"><a href=\"https:\/\/aptnnews.ca\/2019\/02\/14\/pmo-calls-comments-about-jody-wilson-raybould-unacceptable\/\">apology<\/a><\/span> a week later.<\/li>\n<li>Wilson-Raybould resigns from cabinet, followed shortly after by the PMO principal secretary Butts resignation.<\/li>\n<li>Trudeau claims <span style=\"text-decoration: underline;\"><a href=\"https:\/\/globalnews.ca\/news\/4965137\/justin-trudeau-scott-brison-cabinet-shuffle-jody-wilson-raybould\/\">Treasury Board President Scott Brison\u2019s resignation<\/a><\/span> as the reason for her shift to VA.<\/li>\n<li>Privy Council Clerk Wernick testifies no \u201c<a href=\"https:\/\/www.cbc.ca\/news\/wernick-says-there-was-no-inappropriate-pressure-on-wilson-raybould-1.5028647\"><strong><em>i<\/em><\/strong><span style=\"text-decoration: underline;\"><em>nappropriate <\/em>pressure<\/span><\/a>&#8221; occurred.<\/li>\n<li><a href=\"https:\/\/www.cbc.ca\/news\/politics\/snc-lavalin-trudeau-bribery-fraud-wilson-raybould-1.5020498\"><span style=\"text-decoration: underline;\">Heavy SNC lobbying<\/span><\/a> revealed, with claims of serious consequences if prosecution occurs.<\/li>\n<li>Trudeau <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.bnnbloomberg.ca\/trudeau-partially-waives-solicitor-client-privilege-for-wilson-raybould-1.1219842\">partially waives solicitor-client privilege<\/a><\/span>, freeing Ms. Wilson-Raybould to \u201c<span style=\"text-decoration: underline;\"><a href=\"https:\/\/globalnews.ca\/news\/4978794\/justin-trudeau-snc-lavalin-public-inquiry\/\">speak my truth<\/a><\/span>\u201d.<\/li>\n<\/ul>\n<div style=\"float: left; margin-right: 14px;\"><strong><broadstreet-zone zone-id=\"45658\" keywords=\"\" soft-keywords=\"true\" zone-alias=\"\"><\/broadstreet-zone><\/strong><\/div>\n<p>Her testimony was devastating &#8211; detailed, articulate, credible &#8211; confirming 20 meetings\/calls pressuring her\/her staff, involving 11 senior PMO\/government players. She had even warned the PM in September that a political interference line was being crossed &#8211; referencing Trudeau\u2019s comments about the 2018 Quebec election and the PM\u2019s Quebec riding concerns. She also exposed \u201c<span style=\"text-decoration: underline;\"><a href=\"https:\/\/nationalpost.com\/news\/politics\/jody-wilson-raybould-testimony-justin-trudeau-pmo\">veiled threats<\/a><\/span>\u201d if she didn\u2019t bend to the PM\u2019s wishes. More telling, she said the first thing the new AG was to be briefed on by Justice staff was, wait for it\u2026 the SNC case! The <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-wilson-raybould-testimony-snc-lavalin-trudeau-explainer\/\">PM\u2019s response<\/a><\/span>? Denial of wrong doing, and \u201ccomplete disagreement\u201d with her testimony. He was totally outclassed by her. The 3.5-hour testimony and the PM\u2019s response was cringeworthy.<\/p>\n<p><strong>Here is a look at the pertinent aspects of the DPA law:<br \/>\n<\/strong>\u201c<em>The decision as to whether to offer a Remediation Agreement to a corporate accused will be made by the assigned prosecutor, subject to the Attorney General\u2019s consent<\/em>; \u2026 <em>the prosecutor will be required to take certain factors into account when deciding whether to offer a Remediation Agreement, including\u2026.the gravity of the conduct, as well as any history of offending by the organization<\/em>\u201d and importantly <em>\u201c<\/em><a href=\"https:\/\/thetyee.ca\/Analysis\/2019\/02\/15\/JWR-Was-Right\/\"><em><span style=\"text-decoration: underline;\">The prosecutor must not consider the national economic interest, the potential effect on relations with a state other than Canada or the identity of the organization or individual involved\u201d<\/span><\/em><\/a> where an organization is charged under the Corruption of Foreign Public Officials Act.<\/p>\n<p>So, the well documented <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.thetyee.ca\/Analysis\/2019\/02\/22\/SNC-Lavalin-Criminal-Record-Corruption\/\">history of SNC criminal troubles<\/a><\/span> is material. A history that includes a<span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/canada\/snc-lavalin-corruption-fraud-bribery-libya-muhc-1.5010865\"> MUHC hospital bribery scandal, violations of Canada\u2019s election financing laws<\/a><\/span>, (largely benefiting the Federal Liberal Party) and an on-going investigation into the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/globalnews.ca\/news\/4954892\/snc-lavalin-criminal-charges-montreal-bridge\/\">Jacques Cartier Bridge<\/a><\/span> contract. It sure looks like the law is being appropriately applied. It just isn&#8217;t the outcome that Team Trudeau wants. Ms. Wilson-Raybould believes that is why she was shuffled aside in January; the link to Brison\u2019s resignation being nothing more than political cover.<\/p>\n<div style=\"float: left; margin-right: 14px;\"><strong><broadstreet-zone zone-id=\"45658\" keywords=\"\" soft-keywords=\"true\" zone-alias=\"\"><\/broadstreet-zone><\/strong><\/div>\n<p>The PM says he\u2019s worried about Canadian SNC job losses if they face criminal convictions. In truth, he\u2019s far more worried about political backlash in Quebec. If job losses were so critical to him, why has he been so unresponsive to serious economic and jobs\u2019 impacts from disastrous energy policies? What\u2019s so odd here is that he actually has <span style=\"text-decoration: underline;\"><a href=\"https:\/\/nationalpost.com\/opinion\/john-ivison-the-liberals-already-had-a-plan-b-for-snc-lavalin-so-why-did-they-even-bother-risking-a-scandal?video_autoplay=true\">an alternative option<\/a><\/span> to mitigate impacts of a possible subsequent SNC 10-year federal contract ban. The Integrity Regime changes mentioned above give his government discretion to minimize or perhaps waive it entirely. Don\u2019t be fooled, conviction of a few bad executives no longer with the company won\u2019t cause the company to leave or fail. The rule of law must not be held hostage to SNC threats. Sadly, the PM chose the convenient route of political meddling over rule of law.<\/p>\n<p>Ms. Wilson-Raybould has stayed on the moral high ground, maintaining composure and integrity. In stark contrast, the PM is on the defensive &#8211; dodging, deflecting, denying and reacting under a constantly shifting story. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/winnipegsun.com\/opinion\/columnists\/brodbeck-a-reversal-on-snc-lavalin-case-would-obstruct-course-of-justice\">This is dangerous stuff<\/a><\/span>. A major lack of transparency, coupled with <span style=\"text-decoration: underline;\"><a href=\"https:\/\/business.financialpost.com\/opinion\/trudeau-is-making-canada-safe-for-corruption-again-with-the-snc-lavalin-case\">high levels of corporate lobbying and political meddling<\/a><\/span> in our judicial system seriously erodes public trust.<\/p>\n<blockquote class=\"modern-quote full\"><p>Do Canadian\u2019s accept a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/business.financialpost.com\/opinion\/trudeau-is-making-canada-safe-for-corruption-again-with-the-snc-lavalin-case\">two-tier justice system<\/a><\/span> &#8211; one for executives in <em>too-big-to-fail<\/em> politically well-connected companies, and one for the rest of us?<\/p><\/blockquote>\n<p>Justin Trudeau\u2019s <a href=\"https:\/\/pm.gc.ca\/eng\/news\/2015\/11\/04\/prime-minister-justin-trudeaus-open-letter-canadians\">\u201c<span style=\"text-decoration: underline;\">leading an open, honest government that is accountable to Canadians, lives up to the highest ethical standards <\/span><\/a>\u201d pledge rings hollow; his vaunted image as a feminist and Indigenous people champion, shattered in a train wreck of bumbling, hypocrisy, political expediency, and scandal.<\/p>\n<p><strong><em>Dave Wilkin is a Professional Engineer who lives in Huntsville.<\/em><\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Don\u2019t miss out on Doppler!
