Armstrong<\/a><\/span>, Associate professor of operations research, Goodman School of Business, <span style=\"text-decoration: underline;\"><a href=\"http:\/\/theconversation.com\/institutions\/brock-university-1340\" target=\"_blank\" rel=\"noopener\">Brock University<\/a><\/span><\/em><\/strong><\/p>\n<p>Legalized cannabis is just a month away, but <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.ontario.ca\/page\/cannabis-legalization\" target=\"_blank\" rel=\"noopener\">Ontario won\u2019t have<\/a><\/span> any cannabis stores until April. That\u2019s due to the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/theconversation.com\/ontario-uproots-its-plans-for-selling-weed-101855\" target=\"_blank\" rel=\"noopener\">province\u2019s recent decision<\/a><\/span> to have cannabis outlets run by businesses rather than <span style=\"text-decoration: underline;\"><a href=\"https:\/\/ocscannabisupdates.com\/\" target=\"_blank\" rel=\"noopener\">a government agency<\/a><\/span>, although the agency will still open a retail web site Oct. 17.<\/p>\n<p>In the meantime, the provincial government has many regulatory decisions to make about cannabis retailers. Those retailers could easily number in the hundreds or even thousands as many businesses enter the newly legal industry.<\/p>\n<p>For starters, some cannabis growers naturally want to expand vertically into retailing. Aurora Cannabis is eyeing <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/business\/cannabis-ontario-private-retail-1.4784703\" target=\"_blank\" rel=\"noopener\">100 potential stores<\/a><\/span>. Canopy Growth wants <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/canada\/ottawa\/constellation-brands-canopy-growth-1.4785786\" target=\"_blank\" rel=\"noopener\">as many Ontario licenses as possible<\/a><\/span>, and already has some in Newfoundland, Manitoba and Saskatchewan.<\/p>\n<p>Meanwhile, established retailers are expanding horizontally into cannabis. <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/business\/second-cup-cannabis-1.4787563\" target=\"_blank\" rel=\"noopener\">Second Cup may convert<\/a><\/span> some of its 130 Ontario coffee outlets to cannabis. It\u2019s already readying shops in Manitoba, Alberta and British Columbia. Grocer Loblaw is similarly preparing for sales in <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/canada\/newfoundland-labrador\/cannabis-locations-newfoundland-labrador-1.4651799\" target=\"_blank\" rel=\"noopener\">Newfoundland<\/a><\/span> and <span style=\"text-decoration: underline;\"><a href=\"https:\/\/calgary.ctvnews.ca\/grocery-store-chains-set-to-open-licensed-cannabis-shops-in-calgary-1.4051428\" target=\"_blank\" rel=\"noopener\">Alberta<\/a><\/span>, so Ontario could follow.<\/p>\n<h4>Illegal shops may want to be legit<\/h4>\n<p>Many existing illegal pot shops will want into the legal market, but they\u2019ll find it difficult. Ontario\u2019s insisting they <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/canada\/ottawa\/cannabis-dispensary-ontario-stores-legal-1.4785399\" target=\"_blank\" rel=\"noopener\">shut down by Oct. 17<\/a><\/span> if they wish to \u2014 maybe \u2014 sell legally in April.<\/p>\n<p>New cannabis vendors will also appear. Those could include retail chains, like Fire &amp; Flower\u2019s <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.westerninvestor.com\/news\/alberta\/edmonton-based-cannabis-retailer-plans-for-37-stores-ahead-of-national-legalization-1.23406373\" target=\"_blank\" rel=\"noopener\">37 Alberta stores<\/a><\/span>, as well as independent mom-and-pop stores.<\/p>\n<p>Given the wide interest, Ontario can expect far more than the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/theconversation.com\/provinces-prepare-to-push-pot-99324\" target=\"_blank\" rel=\"noopener\">40 shops<\/a><\/span> its previous Liberal government had planned. This leads to the first regulatory question: should the province cap the store count? Other provinces provide hints of what\u2019s possible.<\/p>\n<p>For instance, Saskatchewan limited itself to <span style=\"text-decoration: underline;\"><a href=\"https:\/\/leaderpost.com\/news\/saskatchewan\/pot-shops-picked-here-are-the-people-who-will-be-running-saskatchewans-marijuana-dispensaries\" target=\"_blank\" rel=\"noopener\">just 51 stores<\/a><\/span>, chosen by lottery. Newfoundland\u2019s <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/canada\/newfoundland-labrador\/cannabis-locations-newfoundland-labrador-1.4651799\" target=\"_blank\" rel=\"noopener\">aiming for 30<\/a><\/span>.<\/p>\n<h4>No store cap in Alberta<\/h4>\n<p>By contrast, Alberta isn\u2019t capping store counts, and already had <span style=\"text-decoration: underline;\"><a href=\"https:\/\/calgaryherald.com\/cannabis\/cannabis-business\/calgary-sees-216-cannabis-store-applications-as-total-nears-700-province-wide\" target=\"_blank\" rel=\"noopener\">684 licence applications<\/a><\/span> by mid-August.<\/p>\n<p>Ontario\u2019s numbers will presumably be higher in proportion to its <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www150.statcan.gc.ca\/n1\/pub\/12-581-x\/2018000\/pop-eng.htm\" target=\"_blank\" rel=\"noopener\">larger population<\/a><\/span>. Rationing licences like Saskatchewan and Newfoundland might give it 600 to 800 cannabis stores next year. That\u2019s similar to its <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.lcbo.com\/content\/dam\/lcbo\/corporate-pages\/about\/pdf\/LCBO_AR16-17-english.pdf\" target=\"_blank\" rel=\"noopener\">2,189 total alcohol sellers<\/a><\/span>: LCBO outlets, beer and wine stores.<\/p>\n<h4>Industry structure?<\/h4>\n<p>Aside from store totals, should Ontario otherwise restrict the industry\u2019s structure? For example, Manitoba is limiting the number of store operators. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.winnipegfreepress.com\/local\/manitoba-moves-to-create-legal-cannabis-retailer-depth-chart-488921441.html\" target=\"_blank\" rel=\"noopener\">It\u2019s initially licensed only four chains<\/a><\/span>, though more may follow later.<\/p>\n<p>By contrast, Alberta\u2019s prohibiting anyone from holding <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/canada\/calgary\/cannabis-retail-regulations-alberta-1.4538542\" target=\"_blank\" rel=\"noopener\">more than 15 percent of its retail licences<\/a><\/span>.<\/p>\n<p>Meanwhile, both the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/business\/cannabis-ontario-private-retail-1.4784703\" target=\"_blank\" rel=\"noopener\">Canadian Federation of Independent Business<\/a><\/span> and the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.thespec.com\/news-story\/8818730-ontario-working-out-details-on-how-rules-around-new-pot-plan-would-be-enforced\/\" target=\"_blank\" rel=\"noopener\">Association of Municipalities of Ontario<\/a><\/span> want some Ontario licences reserved for small businesses.<\/p>\n<p>Along with greater store numbers, Ontario can expect more variety. But that might be limited by both existing <a href=\"https:\/\/theconversation.com\/wheres-the-weed-branding-is-essential-for-cannabis-companies-87400\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">federal marketing restrictions<\/span><\/a> and the province\u2019s not-yet-determined rules.<\/p>\n<p>For example, will Ontario only allow standalone cannabis shops? Or will it also permit smaller outlets within larger stores?<\/p>\n<p>Most provinces are focusing on standalones. But many <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/canada\/nova-scotia\/nslc-cannabis-legalization-nova-scotia-sneak-peek-1.4751703\" target=\"_blank\" rel=\"noopener\">Nova Scotia cannabis \u201cstores\u201d<\/a><\/span> are just walled-off sections of liquor outlets. Similarly, some <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.cbc.ca\/news\/canada\/newfoundland-labrador\/cannabis-locations-newfoundland-labrador-1.4651799\" target=\"_blank\" rel=\"noopener\">Newfoundland outlets<\/a><\/span> will sell cannabis the way they sell tobacco, from special counters within larger stores.<\/p>\n<h4>Grocers will want to sell<\/h4>\n<p>In Ontario, big grocers would presumably prefer this approach. Some already have wine outlets or beer aisles. They\u2019d likely emphasize convenience and value but carry limited selections.<\/p>\n<p>Cannabis counters would also fit small towns that can\u2019t support standalone shops. The LCBO already sells liquor this way, via 212 agency stores.<\/p>\n<p>Conversely, standalones would better suit cannabis growers and speciality retailers. They\u2019d offer wider selections and more service.<\/p>\n<p>The provincial government must also decide whether to restrict stores\u2019 sales methods. For example, can cannabis shops openly display products? Or must they hide them, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/theconversation.com\/buying-pot-in-ontario-in-2018-will-be-like-buying-booze-in-1928-95823\" target=\"_blank\" rel=\"noopener\">as liquor stores did in 1928<\/a><\/span>?<\/p>\n<p>Retail employees will need to educate consumers about products, as federal law limits cannabis growers\u2019 advertising. How much advice will \u201cbud-tenders\u201d be permitted to give? (THE CANADIAN PRESS\/Aaron Vincent Elkaim)<\/p><\/div>\n<p>Those employees should take care when travelling. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.cbc.ca\/news\/business\/marijuana-companies-border-1.4823523\" target=\"_blank\" rel=\"noopener\">As Canadians were recently reminded<\/a><\/span>, American border agents can permanently ban cannabis workers from entering the U.S. So, if heading south on vacation, ensure your cars don\u2019t display company parking passes or stickers. And don\u2019t wear cannabis-brand clothing.<\/p>\n<p>Will Ontario permit <span style=\"text-decoration: underline;\"><a href=\"http:\/\/nationalpost.com\/pmn\/news-pmn\/canada-news-pmn\/much-left-to-fight-for-beyond-legalization-pot-activists-say-as-they-mark-4-20\" target=\"_blank\" rel=\"noopener\">cannabis lounges<\/a><\/span> where people can consume when not at home? Those would enable legal smoking for tourists, tenants and condo owners living in non-smoking buildings.<\/p>\n<p>If not lounges for smoking, perhaps cafes for eating? Legal cannabis foods and <span style=\"text-decoration: underline;\"><a href=\"https:\/\/money.cnn.com\/2018\/09\/17\/news\/companies\/coca-cola-cannabis\/index.html\" target=\"_blank\" rel=\"noopener\">beverages<\/a><\/span> will arrive sometime in 2019. On-site consumption would particularly fit the coffee culture some retailers are targeting.<\/p>\n<h4>Like vineyards or brew-pubs<\/h4>\n<p>Then there are small-scale growers. Will Ontario let them sell their own products on-site, as vineyards and brew-pubs do? That could attract tourists and support small businesses.<\/p>\n<p>In making these decisions, Ontario\u2019s government faces several challenges. One is to create trustworthy regulations without micromanaging the retailers. That\u2019s a balance governments <span style=\"text-decoration: underline;\"><a href=\"https:\/\/theconversation.com\/why-doug-ford-should-think-twice-about-changing-booze-and-weed-laws-101249\" target=\"_blank\" rel=\"noopener\">often miss<\/a><\/span>.<\/p>\n<p>Another challenge is to simultaneously promote <span style=\"text-decoration: underline;\"><a href=\"http:\/\/policyoptions.irpp.org\/magazines\/august-2018\/pulling-levers-to-mitigate-health-costs-of-cannabis\/\" target=\"_blank\" rel=\"noopener\">consumer health<\/a><\/span> and industry health. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.theatlantic.com\/health\/archive\/2018\/08\/americas-invisible-pot-addicts\/567886\/\" target=\"_blank\" rel=\"noopener\">Harm reduction<\/a><\/span> is important, but so is a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.thespec.com\/opinion-story\/8845482-ontario-s-cannabis-industry-faces-a-cloudy-future\/\" target=\"_blank\" rel=\"noopener\">robust cannabis industry<\/a><\/span>. Strong legal retailers will <span style=\"text-decoration: underline;\"><a href=\"https:\/\/theconversation.com\/can-government-approved-pot-beat-street-weed-90138\" target=\"_blank\" rel=\"noopener\">compete best against black markets<\/a><\/span>.
