At its June 11 meeting, Huntsville Planning Council unanimously rejected an application to install five temporary food trucks at 7 John Street.<\/p>\n\n\n

According to the planning package, the property, which was sold in 2024, is approximately 4,968m\u00b2 in lot area with 127m of shoreline on the Muskoka River and 127m of road frontage on John Street. The lands are developed with a two-storey commercial building, comprised of the Boston Pizza restaurant, which entered into a 20-year lease for the premises in 2015, office uses, a refreshment stand, a shed, and docks.<\/p>\n\n\n\n

The applicant was applying for temporary (3 years) use of the lands to include four food trucks, a beverage stand, a portable washroom facility, and decks for outdoor seating on the lot, all of which would have required a series of exemptions from planning requirements such as setbacks, a slight increase in the cumulative activity area allowed, as well as reductions in the required lengths of parking spaces and accessible parking. <\/p>\n\n\n\n

Huntsville planning staff was recommending conditional approval of the application. Some of the conditions included a traffic impact brief, adding a native plant species buffer along the shoreline and the removal of the boulders, a tree preservation plan, accessible ramps, and parking spaces, and that the property owner\/s enter into a replacement development agreement on the title of the lands in exchange for approvals.<\/p>\n\n\n\n

Planning consultant Savas Varadas, who was representing the applicant, emphasized that the planning approvals sought were temporary in nature and said his client was requesting that the conditions be waived. <\/p>\n\n\n\n

Varadas also noted that the lands have existing development rights for another building roughly in the same north side of the property where the food trucks are being proposed. He said his client does not want to give those up in exchange for the approval of a temporary land use. <\/p>\n\n\n\n

When asked why the applicant would incur such an expense for temporary use, Varadas said he could not answer that on behalf of the applicant\/s.<\/p>\n\n\n\n

The municipality received several letters objecting to the proposal from area residential and commercial property owners. Counsel for Sam Peters Investments Limited (owner of 6 John Street, 96 Main St. E, 104 Main St. E) and the Manager of Boston Pizza, Mauricio Garcia, spoke at the meeting. Some of the concerns councillors heard included insufficient parking, an increase in traffic, opposition to the number of food trucks proposed, insufficient boat slips, the creation of more refuse, the contravention of the Town’s stated two food trucks per property policy, and the impact the development could have on abutting businesses, notably Boston Pizza which operates on a year-round, not a temporary basis, and relies on its summer traffic to sustain it through the year.<\/p>\n\n\n\n

“I’d like to know why the planning department is recommending approval when the current bylaw says two food trucks per property,” said Councillor Cory Clarke, who added that even if the applicant were to meet all of the conditions requested by staff, he would still not be in favour of the proposal.<\/p>\n\n\n\n

Huntsville Mayor Nancy Alcock expressed concerns about approving the application with all the conditions. “That sets it up for whatever the permanent use is… we’ve granted a number of variances based on this temporary use and… it’s a bit of a back door to get to something else, and that’s what makes me feel a little uncomfortable about this. I wish the applicant was a bit more forthcoming as to the future use,” she said, adding that Boston Pizza has raised some valid arguments, “that you know they’re here all year round, and this is really an important member of our business community who have raised some serious concerns…”<\/p>\n\n\n\n

Deputy Mayor Dan Armour said he felt the same way. “I think there’s a lot of red flags here, and I think we really need to pay attention to what’s going on and what the future holds. As the mayor stated, we do have a long-time business in that area that’s been operating for years and hiring lots of local people, and it’s very busy in the summertime,” said Armour, adding that the road is already a busy one.<\/p>\n\n\n\n

“I don’t think this should’ve come before us. I don’t think that it should’ve come with provisional approval,” said Councillor Bob Stone, who is also chair of the Planning Council. “We’ve been very clear in the past couple of years that two trucks per property is appropriate, especially in that area where there’s several properties that have food trucks, so I certainly can’t support this and don’t think it’s appropriate, and too many red flags as we’ve already noted.”<\/p>\n\n\n\n

The same applicant was before Council in April and returned to the June meeting requesting five rather than the initial seven food trucks proposed.<\/p>\n\n\n\n
